Terms of Service

1. General

These Terms govern the use of CallBuddy.AI (the "Service"), provided by AD Awards Arkadiusz Szustak (VAT PL6912083668), ul. Fabryczna 22, 59-220 Legnica, Poland (the "Provider"). Contact: agent@callbuddy.ai.

2. The Service

CallBuddy.AI is an AI voice assistant: 24/7 call answering, appointment booking, lead call-backs and message handling (phone, WhatsApp, Messenger, email). Features depend on the selected plan (Solo / Plus / Pro / Max).

3. Account & registration

Using the Service requires an account with accurate information. You are responsible for keeping your credentials confidential and for activity on your account.

4. Plans, pricing & billing

The Service is billed as a monthly subscription that starts with a 14-day trial period (§ 4a). The first subscription fee is charged after the trial ends, and then automatically every month until cancelled. Plan and add-on prices are shown at callbuddy.ai/#cennik and are the only prices that apply — the Provider does not operate a list price, a catalogue price or a "regular" price other than the one shown in the pricing. Minutes above your plan allowance are billed at the per-minute rate stated in the pricing after the trial ends. During the trial no overage is charged — a 50-minute test allowance applies (§ 4a).

Taxes — prices shown in the pricing are net prices. For EU businesses outside Poland holding a valid EU VAT number, the reverse charge mechanism applies. For all other buyers, VAT of the buyer's country is added (OSS scheme for electronically supplied services). The final amount including tax is shown at checkout before you confirm the order.

Payment methods — the available payment methods depend on your country and billing currency and are shown at checkout before you confirm the order; card payment is always available.

4a. Trial period (14 days)

Start — every subscription begins with a 14-day trial. A payment card is required at sign-up, but no subscription fee is charged for 14 days (subscription amount charged: 0).

After the trial — on day 15 the subscription automatically becomes paid and your card is charged the full price of the selected plan as shown in the pricing, and then monthly until cancelled.

Cancelling — cancelling in the customer portal (Stripe Customer Portal) before the end of day 14 means no subscription fee at all — neither during nor after the trial.

During the trial we provide a 50-minute test allowance — free of charge, regardless of the plan chosen. Once the 50 minutes are used up, the assistant pauses answering calls until the trial ends (the test limit protects you from unintended costs). During the trial we charge nothing for minutes — neither within the test allowance nor beyond it. The full minute allowance of your chosen plan starts when the subscription becomes paid (on day 15); only then are minutes above the plan allowance billed per the pricing.

One trial per customer — the trial is available once per customer (the same business, regardless of how many accounts or email addresses are created). The Provider may refuse a further trial, or end a trial with immediate effect, where this rule is circumvented.

Promo codes — you may enter a promo code you hold at checkout; a code works together with the trial and applies to your first and subsequent paid invoices, on the terms stated when the code was issued.

5. Promo codes

The prices shown in the pricing are the only prices that apply — the Service is not, and was not, sold at any other "regular", "list" or "catalogue" price. If you hold a promo code (campaign, partner, referral) you may enter it at checkout; its terms and validity period are stated when the code is issued. A code can be used together with the trial and applies to invoices issued after the trial ends.

6. Term & cancellation

Subscriptions renew automatically. You may cancel anytime via the customer portal (Stripe); the Service remains active until the end of the paid period, with no further charges. During the trial, cancelling ends the Service with no charge whatsoever — we charge neither the subscription nor for minutes (§ 4a).

7. Billing, refunds & minute bank

The Service is aimed at businesses (B2B). The Operator provides no results guarantee and no commercial money-back guarantee. This does not affect the statutory right of withdrawal set out in § 8.

Monthly plan — no fixed term; cancel anytime, effective at the end of the paid period.

Nature of the subscription and the minutes — the subscription fee covers keeping the Service available (24/7 assistant readiness, phone number, configuration, infrastructure). Call minutes are granted free of charge, as a bonus attached to a paid subscription; they are not sold separately and cannot be exchanged for cash.

Minute accrual — unused bonus minutes accumulate and do not expire for as long as the subscription is paid, with no accrual cap. Bonus minutes are tied to the subscription — outside the trial period (§ 4a) they are available only while the subscription is paid. During the trial we provide a 50-minute test allowance free of charge (§ 4a); test minutes do not accrue into the subscription minute bank and lapse at the end of the trial (they are not paid out or exchanged). The current minute-bank balance is shown in your panel. Cancellation — when the paid period ends, the subscription expires and any accrued unused bonus minutes lapse.

Suspension for non-payment — failure to pay on time results in full suspension of the Service (the assistant stops answering calls and handling messages). You have a 7-day grace period to pay; payment within that period restores the Service together with the accrued bonus minutes. If the grace period lapses without payment, unused bonus minutes expire, together with the entitlement to the bonus attached to an unpaid subscription. Minutes cannot be exchanged for cash.

8. Right of withdrawal (consumers and sole traders acting outside their profession)

This section applies to consumers and to natural persons entering into a contract directly connected with their business activity where the contract is not of a professional nature for them (Art. 7aa and 38a of the Polish Consumer Rights Act, implementing Directive 2011/83/EU).

Period — you may withdraw from the contract within 14 days of concluding it, without giving a reason and without incurring costs, subject to the rules below.

How to withdraw — an unambiguous statement sent to agent@callbuddy.ai is enough (you may use the statutory model withdrawal form, but you do not have to). Sending the statement before the deadline is sufficient to meet it.

Effects — we refund all payments received from you without undue delay and no later than 14 days after receiving your statement, using the same means of payment you used.

Starting the service before the period ends — the service is activated immediately after purchase, i.e. still within the trial. When placing the order you tick a consent at checkout reading: *"I request that the service starts before the withdrawal period ends and I acknowledge that, if I withdraw, I will pay for the service supplied up to that moment (pro rata), and that I lose the right of withdrawal once the service has been fully performed"* (Art. 14(4) and Art. 16(m) of Directive 2011/83/EU).

Trial and withdrawal are two different things — the 14-day statutory withdrawal period (a consumer right, described in this section) and the 14-day commercial trial (§ 4a, available to every customer, including businesses) run in parallel, from the day the contract is concluded. Because the subscription price during the trial is zero and we do not bill minutes during that period (50-minute test limit), the pro-rata amount payable if you withdraw during the trial is zero — nothing remains payable. Withdrawal does not extend the trial, and the trial does not extend the withdrawal period.

Consent is a condition of the immediate start — the service is activated right away, so placing an order requires ticking the consent above. Without it no order is placed; the trial and performance begin when the order is confirmed together with the consent.

Exception — the statutory right of withdrawal does not apply to businesses other than those described above. This does not affect their 14-day trial (§ 4a) or their right to cancel the subscription at any time (§ 6).

9. Data, privacy & outbound calls

Data is processed in the European Union, in line with GDPR and the AI Act. Where a provider processes data outside the European Economic Area, this is based on Standard Contractual Clauses (SCC). See the Privacy Policy for details. You are responsible for lawful use of the Service towards callers (incl. notifying about recording, if enabled).

Outbound calls (incl. the call-back / Revive module) — you represent that you hold a legal basis for calling the people in any list passed to outbound features, including the consent required by Art. 172 of the Polish Telecommunications Law (use of automated calling systems) and, on other markets, by the applicable national rules (e.g. § 7 UWG in Germany). The Provider may suspend outbound features on reasonable suspicion of a breach.

10. Liability

The Service is provided with due care, but the Provider does not warrant uninterrupted or error-free operation (which depends on telecom and AI providers, among others). Liability is limited to the fees paid in the last billing period, to the extent permitted by law.

11. Intellectual property

All rights to the Service, brand and software belong to the Provider. You retain rights to your own data and content.

12. Referral programme

A customer with an active subscription may receive an individual referral code. For each successful referral both sides (referrer and referred customer) receive an invoice credit of PLN 100 / EUR 25 / GBP 20 (depending on the billing currency). The credit is granted after the referred customer pays their first invoice and can only be applied to subsequent invoices for the Service — it is not paid out in cash and cannot be exchanged for money. Self-referral (the same customer/account) does not qualify. Any tax obligations arising from the credit are borne by its recipient. The Provider may change the terms of the programme or end it at any time, without affecting credits already earned.

13. Changes

The Provider may amend these Terms for valid reasons, with prior notice by email.

14. Governing law

These Terms are governed by Polish law. Disputes are resolved by the court competent for the Provider's registered office, unless mandatory law provides otherwise.
